Zap Cloth® and Zezo Fiber® are registered trademarks. ALL RIGHTS NOT
EXPRESSLY GRANTED HEREIN ARE RESERVED. Unless the context indicates
otherwise, the term "we" or "our" or "us" or "Kaywos, Inc." or "Bryan Pinkham"
refers to the owner of these registered trademarks and the Zap Cloth
Website; the term "you" or "your" or "customer" or "distributor" refers to
the viewer or user of the Zap Cloth Website. You must agree to the following
Terms and Conditions in order to distribute the Zap Cloth® and violating any
of these Terms and Conditions may, at our sole discretion and without prior
notice to you, terminate your privileges to distribute the Zap Cloth®.
The Zap Cloth® will not be sold or offered on any on-line auction. To
establish a website using the “Zap Cloth” name is permitted only if you
comply with the price structure on www.zapcloth.com.
It is not permitted to pay any on-line search engine “paid ads” to boost
standings in the keyword search using the “zap” name, "kaywos" name, or
“zezo fiber.”
The Zap Cloth generally retails for 2 cloths for $10.00 or 5 cloths for $20.00. We ask that you comply with that price structure. In some instances,
it is ok to sell the cloths at 3 cloths for $10.00 only at a retail outlet. We ask you to agree to never sell below the price of $5.00 each or 3 for $10.00
(on an advertised price) at a retail outlet. For any on-line or website sales, you must ask a minimum amount of $6.00 each, 2 for $10.00, 5 for $20.00, 10
for $35.00, etc. (see pricing on Zap Cloth page.) Any and all TV advertising must first be approved by Kaywos, Inc.
It is not permitted to sell or promote competitive products using the
“zap” name, “kaywos” name, or “zezo fiber” and it is not permitted to
substitute alternative products for the Zap Cloth®.
By using the Zap Cloth
Website, you understand and expressly agree to be legally bound by our
Terms of Use; our
Privacy Policy, which is part of our Terms of Use; and our Terms and
Conditions for distributors of the Zap Cloth®, which becomes part of our
Terms of Use when you fill out this distributor application, enter your
initials in the text box as indicated, and select "I Agree;" and to follow
our Terms of Use and all applicable laws and regulations governing the Zap
Cloth Website.
You agree that distributors of the Zap Cloth® are independent individuals
or businesses (third parties), solely responsible for their own business and
are not an employee, franchise, nor agent of Kaywos, Inc. We do not assume any
responsibility or liability for the actions, products, and/or website
content of these third parties and any other third parties.
We reserve the right to update or modify these Terms and Conditions at
any time without prior notice to you. It is your sole responsibility to
check for changes to these Terms and Conditions. These Terms and Conditions
were last updated on February 13, 2013.
